1. Definitions
In these Terms and Conditions, the following words have the meanings set out below:
- "Agreement" — these Terms and Conditions, together with any service quotation or written confirmation we provide.
- "We / Us / Our" — Lumecase, a watch repair business at 91 Phaholyothin Road, Chatuchak, Bangkok 10900, Thailand.
- "You / User" — any person who visits our website or submits an enquiry or brings a watch in for service.
- "Service" — any watch repair or refinishing work carried out by Lumecase, including Lume & Hands Refresh, Case Refinishing, and Complete Mechanical Service.
- "Website" — the site located at lumecase.biz and all pages within it.
- "Content" — all text, images, descriptions, and other material published on the Website.
2. Acceptance of Terms
By using our Website or submitting a service request, you confirm that you have read and accept these terms. If you do not agree, please do not use our Website or request a service.
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are submitting a request on behalf of another person or organisation, you confirm that you have authority to do so.
3. Service Description
Lumecase offers watch repair and refinishing services to clients in Bangkok and Thailand. Our current services are:
- Lume & Hands Refresh — ฿3,600
- Case Refinishing — ฿6,800
- Complete Mechanical Service — ฿11,300
Service availability is subject to our current workload and assessment of each piece. We reserve the right to decline a service request if the work is outside our scope or the watch condition does not allow safe servicing.
Prices listed are indicative. A final quotation will be provided after we have assessed the watch in person or reviewed submitted photographs. Work will not proceed without your confirmation of the quoted price.
4. User Responsibilities
When using our Website or submitting a service request, you agree to:
- Provide accurate and complete information when making an enquiry.
- Own, or have authority to submit for service, any watch you bring to us.
- Not use this Website for any unlawful or deceptive purpose.
- Not attempt to access systems, data, or content you are not authorised to access.
- Not reproduce, redistribute, or commercially use our Content without written permission.
We reserve the right to decline service or restrict access to the Website if we believe these responsibilities have not been met.
5. Intellectual Property
All content on this Website — including text, photographs, layout, and design — is owned by or licensed to Lumecase. You may view and print pages for personal, non-commercial reference only. You may not copy, republish, or use our Content commercially without prior written consent.
Nothing in these Terms transfers any intellectual property rights to you. All trade names, service marks, and branding on this Website remain the property of their respective owners.
6. Payment Terms
Payment is due upon collection of your watch, unless otherwise agreed in writing. We accept cash and bank transfer in Thai Baht (฿). Other payment arrangements may be discussed at the time of service.
If work has been carried out in good faith based on your confirmation and you subsequently decline to pay, we reserve the right to retain the watch until payment is received in full, in accordance with Thai law.
Refunds
If you are dissatisfied with the work carried out, please contact us within 14 days of collection. We will review the concern and, at our discretion, may offer to rectify the work at no additional charge. Refunds are considered where work demonstrably falls short of the agreed scope. We do not offer refunds for the time and materials already expended in good-faith work.
7. Service-Specific Terms
Assessment and Scope
Each watch is assessed individually before work begins. Where additional issues are discovered during service, we will contact you to discuss scope and cost before proceeding further.
Condition Documentation
For Complete Mechanical Service, we provide a written condition note documenting the movement's state before and after service. This note is for reference only and does not constitute a valuation or independent assessment.
Coverage Period
Work carries a coverage period as communicated at the time of service. This covers workmanship related to the specific service carried out. It does not cover damage caused by impact, moisture ingress, misuse, or unrelated component failure.
Uncollected Watches
If a watch is left with us and not collected within 90 days of notification that work is complete, we will make reasonable efforts to contact you. After 6 months without response, we may take further steps in accordance with Thai law regarding unclaimed goods.
8. Disclaimers
The information on our Website is provided in good faith for general guidance about our services. We make no representations that content is complete, error-free, or continuously updated.
Watch repair work is carried out with care and skill, but the outcome is subject to the condition and history of each individual piece. We cannot predict or promise specific performance results from a service.
Nothing on this Website constitutes professional advice specific to your situation. We recommend discussing your watch's needs with us directly before proceeding.
9. Limitation of Liability
To the fullest extent permitted under Thai law, Lumecase shall not be liable for:
- Indirect, consequential, or incidental losses arising from use of this Website.
- Loss of data or business arising from website downtime or technical errors.
- Damage to a watch caused by pre-existing conditions or undisclosed prior repairs.
- Loss of value arising from normal wear or handling during servicing.
Where liability cannot be excluded by law, our total liability for any claim arising from a service is capped at the amount you paid for that specific service.
10. Indemnification
You agree to indemnify Lumecase against any claims, losses, or expenses arising from your misuse of this Website, breach of these Terms, or provision of inaccurate information in connection with a service request.
11. Termination
Either party may withdraw from a service agreement before work has begun, without penalty, by notifying the other in writing or by telephone. Once work has commenced, any withdrawal is subject to a fair assessment of time and materials already expended.
We reserve the right to refuse or discontinue service to any person at our reasonable discretion. Provisions regarding payment, intellectual property, limitation of liability, and dispute resolution survive any termination.
12. Dispute Resolution
These Terms are governed by the laws of the Kingdom of Thailand. Any dispute arising from or in connection with these Terms or a service provided by Lumecase shall first be addressed through good-faith discussion between the parties.
If a resolution cannot be reached through discussion within 30 days, the matter may be referred to mediation. If mediation does not resolve the dispute, proceedings may be brought in the courts of Bangkok, Thailand.
Consumers in Thailand also have rights under the Consumer Protection Act B.E. 2522 and related legislation, which are not affected by these Terms.
13. General Provisions
- Entire Agreement — these Terms, together with any service quotation, represent the full agreement between the parties regarding the subject matter.
- Severability — if any provision is found unenforceable, the remaining provisions continue in full effect.
- Waiver — failure to enforce any provision does not constitute a waiver of the right to do so in future.
- Assignment — you may not assign your rights under these Terms without our written consent. We may transfer our obligations to a successor business, with reasonable notice to you.
- Notices — notices under these Terms may be sent by email to the addresses noted in the Contact section below.
14. Changes to These Terms
We may update these Terms from time to time. When we do, the revised version will be published on this page with an updated effective date. Continued use of our Website or services after the revised Terms take effect constitutes acceptance of the changes. If you do not agree to a revision, please discontinue use of our Website.
